The statute of limitations (absolute deadline) for filing your initial application for NICA benefits is five years from the baby's date of birth.  On the other hand, the statute of limitations for filing a medical malpractice claim is much more complicated and can range from two years to eight years after the date of birth, depending on the unique circumstances.  In order to determine if you have an option of bringing a medical malpractice claim you should contact a malpractice attorney promptly.  Potential malpractice claims may take months to investigate, and even the easier "no-fault" NICA petition takes a great deal of information gathering before the petition seeking benefits can be filed.
